These Terms and Conditions (“Terms”) govern the sale of products through shopkineto.com (the “Website”). Please read them carefully before placing an order. By placing an order you confirm that you accept these Terms.

ShopKineto is operated by HongKong AdTiger Media Co., Limited, a company incorporated in the Hong Kong Special Administrative Region of the People’s Republic of China, with its registered office at Room 703, 7/F Kowloon Building, 555 Nathan Road, Kowloon City, Kowloon, Hong Kong (“ShopKineto”, “we”, “us”, “our”). This document is organised in two parts. Part 1 sets out the terms that apply to our cash-on-delivery (COD) and other sales to customers located in the European Union / European Economic Area (“EU/EEA”), which is our primary market. Part 2 sets out how we, as a company established in Hong Kong, comply with Hong Kong law, and the terms that apply to customers located outside the EU/EEA. Where both parts could apply to you, the more specific and more protective provisions of Part 1 prevail for EU/EEA consumers; nothing in Part 2 reduces the rights granted to you in Part 1.

Definitions

• “Consumer” means a natural person acting for purposes outside their trade, business, craft or profession.
• “Products” means the goods offered for sale on the Website.
• “Order” means your request to purchase Products from us.
• “Contract” means the contract of sale between you and us for the Products.

By using the Website and placing an Order, you agree to be bound by these Terms, together with our Privacy Policy, Cookie Policy, Shipping Policy and Refund & Returns Policy, which are incorporated by reference. If you do not agree, please do not place an Order.

Part 1 — Sales to European Union / EEA consumers (cash-on-delivery)

1.1 Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to place an Order. By ordering, you confirm that you meet these requirements and that the information you provide is accurate and complete.

1.2 Products, descriptions and availability

We take care to describe and picture our Products accurately, so that you can make an informed decision before ordering. Images are for illustration only, and slight variations in colour, packaging or minor detail may occur. All Products are subject to availability. We may withdraw a Product, or correct an error in its description or price, at any time before your Order is accepted.

1.3 Prices and taxes

Prices are shown on the Website in the currency indicated at checkout and are subject to change, but changes do not affect Orders we have already accepted.

Unless stated otherwise, prices for consumers include applicable value-added tax (VAT). Where an Order is shipped from outside the EU/EEA, additional import duties or taxes may apply and are described in our Shipping Policy.

Any delivery or cash-on-delivery charges are shown separately before you confirm your Order.

If we discover an obvious pricing error, we are not obliged to supply the Product at the incorrect price and will contact you before proceeding.

1.4 How a Contract is formed

Your Order is an offer to buy. After you place an Order, we will send you an acknowledgement confirming that we have received it; this acknowledgement does not by itself form a Contract. The Contract is formed only when we confirm that your Order has been accepted or when we dispatch the Products, whichever happens first. We reserve the right to decline any Order, for example where a Product is unavailable, where we cannot obtain authorisation for payment, where we suspect fraud, or where there has been a pricing or description error.

1.5 Payment, including cash on delivery

We accept the payment methods displayed at checkout, which may include cash on delivery (COD) and, where offered, secure online payment. Where you choose cash on delivery, you agree to pay the full amount (including any applicable charges) to the courier at the time of delivery. Online payments are processed by third-party payment providers; we do not store your full card details.

1.6 Delivery

We deliver to the destinations, and within the timeframes, set out in our Shipping Policy, which forms part of these Terms. Delivery times are estimates and are not guaranteed unless expressly agreed. Risk in the Products passes to you on delivery.

1.7 Right of withdrawal for EU/EEA consumers

If you are a consumer in the EU/EEA, you have the right to withdraw from your Contract within 14 days of receiving the Products, without giving any reason, in accordance with Directive 2011/83/EU on consumer rights. Full details of how to exercise this right, the conditions, and the refund process are set out in our Refund & Returns Policy, which includes a model withdrawal form.

1.8 Legal guarantee of conformity

Where you buy as a consumer in the EU/EEA, the Products benefit from the statutory guarantee of conformity: we are liable for any lack of conformity that becomes apparent within two years of delivery, in accordance with Directive (EU) 2019/771 and the consumer-protection law of your country. If a Product is faulty, not as described, or not fit for its purpose, you are entitled to have it repaired or replaced and, where appropriate, to a price reduction or a refund. These statutory rights are not affected by any commercial warranty we may offer or by these Terms.

1.9 Returns and refunds

Your rights to return Products and receive refunds — whether under the right of withdrawal or the legal guarantee — are described in detail in our Refund & Returns Policy.

1.10 Complaints and dispute resolution

We want you to be satisfied. If you have a complaint, please contact us first at info@shopkineto.com so we can try to resolve it. If we cannot resolve your complaint directly, EU/EEA consumers may be able to use an alternative dispute resolution (ADR) body in their country, or seek assistance from the European Consumer Centres Network (ECC-Net) for cross-border purchases. (The former EU Online Dispute Resolution platform was discontinued on 20 July 2025 and is no longer available.)

1.11 Mandatory consumer rights preserved

If you are a consumer in the EU/EEA, you benefit from, and may bring proceedings under, the mandatory consumer-protection provisions of the law of your country of residence, and nothing in these Terms (including Part 2 below) deprives you of that protection.

Part 2 — Hong Kong compliance and other customers

HongKong AdTiger Media Co., Limited is a company incorporated in Hong Kong. This Part sets out our company information, describes how our sale of Products complies with Hong Kong law, and governs customers located outside the EU/EEA. It does not reduce any right granted to EU/EEA consumers under Part 1.

2.2 Accurate description of goods (Trade Descriptions Ordinance)

Under the Trade Descriptions Ordinance, Cap. 362 of the laws of Hong Kong, we must not apply a false or misleading trade description to the Products we sell, and we must not omit material information that a reasonable consumer would need to make an informed transactional decision (for example, about price, availability, delivery times, or the existence of a right to a refund). We apply the same standard globally, including in our advertising on platforms such as Google Ads and Google Shopping, and we keep our product pages, Merchant Center listings and advertising consistent.

2.3 Implied terms (Sale of Goods Ordinance)

Where Hong Kong law applies to your Contract (see Section 2.6), the Sale of Goods Ordinance, Cap. 26, implies conditions and warranties into the Contract, including that the Products correspond with their description, are of merchantable quality, and are reasonably fit for any particular purpose you made known to us. Section 2.5 of the Control of Exemption Clauses Ordinance, Cap. 71, means that, as against a person dealing as a consumer, we cannot exclude or restrict our liability for breach of these implied terms.

2.4 Electronic contracts (Electronic Transactions Ordinance)

Under the Electronic Transactions Ordinance, Cap. 553, an Order placed and accepted electronically, and any electronic record or communication exchanged between us (including order confirmations), has the same legal effect as if it had been made on paper or signed by hand.

2.5 Customers outside the EU/EEA

If you are ordering from outside the EU/EEA, the withdrawal right described in Section 1.7 does not apply to you as a matter of EU law; instead, we offer a voluntary return option described in our Refund & Returns Policy (currently a 30-day window from delivery), which meets or exceeds the minimum return-window requirements of Google Merchant Center. This voluntary policy does not limit any mandatory right you may have under the law of your own country.

2.6 Governing law and jurisdiction

These Terms, and any Contract with a customer located outside the EU/EEA, are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have non-exclusive jurisdiction over any dispute, without prejudice to your right to bring proceedings in your own country’s courts where mandatory consumer law so provides. For consumers in the EU/EEA, Section 1.11 above applies and is not affected by this clause.

General Provisions

Your Responsibilities and Acceptable Use

• You agree to provide accurate delivery and contact information and to be available to receive delivery.
• You agree not to use the Website for any unlawful, fraudulent or abusive purpose, not to place speculative or false Orders, and not to interfere with the Website’s operation or security.
• You agree not to reproduce, copy or resell any part of the Website except as permitted by law.

Intellectual Property

All content on the Website — including text, graphics, logos, images, product descriptions and the “ShopKineto” brand — is owned by or licensed to us and is protected by intellectual-property laws. You may not use it without our prior written permission, except as necessary to use the Website for its intended purpose.

Our Liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for the statutory rights of consumers. Subject to that, we are not liable for losses that were not foreseeable, for losses not caused by our breach, or for business losses where you use the Products for any commercial purpose. Our total liability arising out of any Contract shall not exceed the price paid for the relevant Products, except where a higher amount is required by mandatory law.

Events Beyond Our Control (Force Majeure)

We are not responsible for any failure or delay in performing our obligations where that failure or delay is caused by events beyond our reasonable control, such as natural disasters, extreme weather, epidemics, strikes, transport disruption, failure of utilities or communications networks, or acts of government. We will take reasonable steps to minimise the effect of any such event.

Changes to These Terms

We may amend these Terms from time to time. The version applicable to your Order is the one in force at the time you place it. Please review the Terms each time you order.

Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect. Our failure to enforce a right is not a waiver of that right. You may not transfer your rights under a Contract without our consent; we may transfer ours where your rights are not affected.
